Trofeo is not responsible for any interactions, contact, harassment, or other consequences that may result from the public sharing of location-based activity data.
Home and Sensitive Location Privacy
Activities recorded with GPS-enabled devices may reveal sensitive location information, such as your home, workplace, or other frequently visited locations. If activities are shared publicly or with other users, route maps and activity details may allow others to infer these locations.
Trofeo may provide privacy controls that allow you to adjust the visibility of your activities or obscure portions of routes near certain locations. These settings are designed to help reduce the risk of exposing sensitive locations.
You are responsible for reviewing and configuring your privacy settings according to your preferences. If activities are shared publicly, location information associated with those activities may be visible to other users of the Services.
You should carefully consider whether to publicly share activities that begin or end at locations you consider sensitive. Once location information has been shared publicly, Trofeo cannot guarantee that it will remain private or that it will not be copied or redistributed by other users.
Users should avoid recording or sharing activities in locations where activity recording or public sharing may be restricted or inappropriate.
Limitations of Privacy Controls

However, no software system can guarantee that privacy settings will operate perfectly in all circumstances. Trofeo will take reasonable steps to address confirmed issues and restore the intended privacy settings, but cannot guarantee that information already viewed, cached, or copied by other users can be completely removed.
Aggregated and De-Identified Data
Trofeo may create aggregated, anonymized, or de-identified data derived from user activity and usage of the Services.
This information is processed in a manner that does not reasonably identify individual users and cannot be linked back to a specific person.

Trofeo is a fitness and outdoor activity platform that allows users to record, upload, analyze, and share activities such as running, cycling, hiking, and other outdoor activities.
The Services may include activity tracking, GPS route mapping, segments, leaderboards, social interactions, analytics, and other related features.
Right to Modify or Discontinue Services
Trofeo continuously improves and evolves the Services. As part of this process, Trofeo may modify, update, suspend, or discontinue certain features, functionalities, integrations, or portions of the Services at any time.
This may include changes to segments, leaderboards, analytics, training insights, device integrations, or other platform features.
Trofeo may also introduce new features, modify existing functionality, or remove features that are no longer supported, practical, or consistent with the operation of the platform.
Where reasonably practicable, Trofeo may provide notice of significant changes through the Services or other communication channels. However, Trofeo is not obligated to maintain any specific feature or functionality for any particular period of time.
Trofeo shall not be liable for the modification, suspension, or discontinuation of any part of the Services.
User Accounts
You must be at least 13 years old to use the Services. If you are under 18, you must have permission from a parent or guardian.

You retain ownership of your User Content. However, by submitting content through the Services you grant Trofeo a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for the purpose of operating and improving the Services.
Intellectual Property
The Services, including the Trofeo website, software, design, logos, trademarks, graphics, and other content provided by Trofeo, are owned by or licensed to Trofeo and are protected by intellectual property laws.
Except as expressly permitted by these Terms, users may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from the Services without prior written permission from Trofeo.
User Responsibility for Content
Users are solely responsible for any content they upload, share, or publish through the Services, including activities, routes, comments, photos, and other materials.
Trofeo does not pre-screen all user-generated content and does not guarantee the accuracy, safety, or legality of content shared by users.
Outdoor Activity Risk Disclaimer
Outdoor activities such as running, cycling, hiking, and similar activities involve inherent risks, including but not limited to accidents, collisions, injury, illness, environmental hazards, equipment failure, and interactions with vehicles, terrain, wildlife, or other participants.
By using the Services to record, share, view, or participate in activities, you acknowledge and voluntarily assume all risks associated with these activities.
You are solely responsible for evaluating your own physical condition, abilities, equipment, and surroundings before participating in any activity.
Trofeo does not provide medical, safety, training, or professional advice.
Use of the Services at Your Own Risk
You use the Services at your own risk. Trofeo is not responsible for the actions of users while participating in activities recorded or shared through the Services.
Information provided through the Services, including routes, maps, analytics, or activity data, may be incomplete, inaccurate, or outdated. Users are responsible for verifying conditions and exercising independent judgment before engaging in any activity.
Users should not view or interact with the Services in a manner that distracts them from the safe operation of a bicycle, vehicle, or other equipment while in motion.
Segments and Competition
Segments, routes, and performance comparisons available through the Services may be generated automatically from user activity data or contributed by other users.
Trofeo does not review or verify the safety, legality, or suitability of any segment, route, or location displayed on the platform.
Routes, segments, and activities displayed through the Services may pass through public roads, trails, private property, restricted areas, or locations subject to changing regulations. Trofeo does not verify whether access to any road, trail, or location is permitted at any given time.
Users are solely responsible for determining whether access to a particular location is lawful and appropriate before entering or recording activities in that area.
Segments may encourage competitive comparisons between users; however, Trofeo does not encourage unsafe behavior, violations of traffic laws, or participation in activities beyond a user's abilities.
Users are solely responsible for exercising reasonable judgment, complying with traffic laws and local regulations, and prioritizing safety when participating in activities or attempting segments.
Leaderboards, rankings, segment records, and other performance comparisons provided through the Services are intended for informational, recreational, and gamification purposes only.
These features are generated from user-submitted activity data and automated analysis of that data. While Trofeo makes reasonable efforts to maintain the integrity of rankings and detect potential violations such as suspicious activity or data manipulation, the platform cannot guarantee that all activity data or rankings will be accurate, complete, or free from error.
Leaderboard positions, segment results, and performance metrics do not create any contractual rights or entitlements. Rankings may change due to privacy settings, data corrections, recalculations, algorithm updates, technical issues, or moderation actions.
Trofeo reserves the right, at its sole discretion, to remove, adjust, recalculate, or invalidate activities, segment results, or leaderboard rankings where necessary to maintain platform integrity or address suspected violations of these Terms.
Users may report suspected technical issues, errors, or potential violations through the Services or by contacting support@trofeo.fit. Trofeo will review such reports at its discretion and is not obligated to resolve disputes regarding leaderboard positions, rankings, or competitive outcomes.
Segments, routes, and related leaderboard data may be derived from activities uploaded by users. By submitting activity data to the Services, you acknowledge that such data may contribute to the creation of segments or routes within the platform. Users do not obtain ownership or exclusive rights to any segment, route, or leaderboard generated from user activity data.
Deletion of an activity or modification of its privacy settings does not necessarily result in removal of segments, routes, or aggregated leaderboard data derived from that activity. Trofeo may retain and continue to use derived segment data in order to operate, maintain, and improve the Services.
Users are responsible for ensuring that activities recorded or uploaded to the Services are conducted in locations where recording, sharing, or publication of such data is lawful and appropriate.
Users are solely responsible for complying with all applicable laws, regulations, and property rights when recording or sharing activities. If an activity or route is recorded in a location that should not be publicly disclosed, the user is responsible for adjusting privacy settings or removing the activity from the Services.
Leaderboard and Data Integrity
Trofeo may remove activities, adjust results, recalculate rankings, or restrict accounts if activities are suspected of being inaccurate, manipulated, or inconsistent with fair participation.
Trofeo reserves the right, at its sole discretion, to modify, remove, or invalidate activities, segments, or leaderboard results in order to maintain the fairness, accuracy, and integrity of the platform.
Leaderboard results and rankings may change over time due to newly recorded activities, privacy setting changes, data corrections, algorithm updates, or technical adjustments to the Services.
Devices and Data Accuracy
The Services may receive activity data from user devices, sensors, or third-party platforms such as fitness trackers or external activity services.
Trofeo does not guarantee the accuracy, completeness, or reliability of activity data provided by devices, sensors, or third-party integrations.
Device malfunctions, GPS inaccuracies, sensor errors, synchronization delays, or data transmission issues may affect activity results, metrics, analytics, route maps, or leaderboard rankings.
Maps, routes, and location information displayed through the Services may contain inaccuracies or incomplete information due to limitations of GPS signals, mapping data sources, device capabilities, or environmental conditions.
Trofeo does not guarantee that map data, route paths, or location-based information are accurate or suitable for navigation. Users are responsible for evaluating their surroundings and exercising independent judgment when navigating roads, trails, or other environments.
Users acknowledge that Trofeo is not responsible for inaccuracies caused by external devices, sensors, mapping data providers, or third-party services that supply activity or location data to the platform.
Health and Training Information
The Services may provide training insights, performance analytics, activity recommendations, or other informational content related to fitness, exercise, nutrition, or wellness.
Such information is provided for general informational and educational purposes only and is not intended to constitute medical advice, diagnosis, or treatment.
Trofeo does not provide medical services and does not guarantee that any recommendations, analytics, or insights generated by the Services are appropriate for your individual health conditions or fitness level.
Users are responsible for exercising reasonable judgment when participating in physical activities and should consult a qualified healthcare professional before beginning or modifying any training program, particularly if they have underlying medical conditions, injuries, or health concerns.
If you experience pain, discomfort, dizziness, injury, or other health-related symptoms while engaging in activities or following training suggestions, you should discontinue the activity and seek appropriate medical advice.
The Services are not intended to function as a medical device, health monitoring system, or emergency response service. Trofeo does not monitor users in real time and does not contact emergency services if unusual activity, heart rate readings, or other metrics are detected.
Service Availability
Trofeo strives to maintain reliable and secure operation of the Services. However, the Services may occasionally be unavailable due to maintenance, updates, technical issues, or factors outside of Trofeo’s control.
The availability and performance of the Services may also depend on third-party services, devices, networks, or infrastructure providers that Trofeo does not control.
Accordingly, Trofeo does not guarantee that the Services will be available at all times, uninterrupted, secure, or error-free.
Trofeo may temporarily suspend or limit access to the Services for maintenance, upgrades, security reasons, or other operational purposes.
Service Disclaimer
The Services are provided on an “as is” and “as available” basis.
Trofeo makes no warranties regarding the reliability, accuracy, or availability of the Services.
Limitation of Liability
To the maximum extent permitted by law, Trofeo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Services.
Trofeo is not responsible for injuries, accidents, property damage, or other consequences resulting from participation in activities recorded or shared through the Services.
To the maximum extent permitted by law, Trofeo's total liability arising from the use of the Services shall not exceed the amount paid by the user to Trofeo during the twelve months preceding the claim.
To the fullest extent permitted by law, you release and hold harmless Trofeo and its officers, employees, affiliates, and partners from any claims, damages, injuries, or losses arising from participation in activities recorded, shared, or viewed through the Services.
The Services are not intended for use in emergency situations and should not be relied upon for navigation, safety, or rescue purposes.
Indemnification
You agree to defend, indemnify, and hold harmless Trofeo and its affiliates, officers, employees, and partners from any claims or damages arising from your use of the Services or violation of these Terms.
Termination
Trofeo may suspend, restrict, or terminate your access to the Services at any time if we reasonably believe that you have violated these Terms or used the Services in a manner that may harm the platform, other users, or third parties.
This may include attempts to abuse platform functionality, circumvent rate limits, manipulate activity data or leaderboards, or interfere with the integrity or availability of the Services.
In cases of serious misuse or abuse of the Services, Trofeo reserves the right to suspend or terminate accounts without refund of any subscription fees previously paid, to the extent permitted by law.
Trofeo may also remove content, restrict features, or limit access to certain parts of the Services as part of enforcement actions.
Changes to the Terms
Trofeo may update these Terms from time to time.
Updated Terms will be posted on this page with a revised “Last Updated” date.
Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
Dispute Resolution and Arbitration
To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be resolved through binding arbitration rather than in court.
Arbitration will be conducted on an individual basis and not as a class action, collective action, or representative proceeding. You and Trofeo agree to waive the right to participate in any class-action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of law where necessary to protect intellectual property rights, confidential information, or platform security.
Either party may bring claims in small claims court if the claims qualify.
Force Majeure
Trofeo will not be liable for any failure or delay in the performance of the Services resulting from events beyond our reasonable control.
Such events may include natural disasters, acts of government, war, civil unrest, labor disputes, widespread internet outages, failures of telecommunications networks, cloud infrastructure failures, or other events that could not reasonably have been prevented.
During such events, Trofeo may temporarily suspend or limit availability of the Services until normal operations can be restored.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles.
To the extent that any dispute is permitted to be brought in a court of law rather than arbitration, such dispute shall be brought exclusively in the state or federal courts located in Santa Clara County, California.
